Definitions:
Landlord Assist means Landlord Assist Limited provider of services to the lettings industry. Registered Office: 65 Ruskin Avenue, Rogerstone, Newport, Gwent NP10 0AA.
"Web Site" means both the public and secure components of the internet domain www.onlinereferencing.co.uk
"Client" A company organisation or individual which/whom has been provided with an account in order to use our tenant referencing service.
"Applicant" A prospective Tenant or Guarantor who accesses the web site to provide information to permit an individual assessment to be carried out.
Security:
Landlord Assist are committed to protecting the privacy of the information you provide to us even when you are no longer a user of the system. Please be aware that the control of security of account numbers and passwords and the like are the sole responsibility of the Client or Applicant as appropriate. Landlord Assist will not accept any responsibility whether direct, indirect or consequential occasioned by use of the aforementioned security items by unauthorised persons.
Each Applicant will be provided with a link for the sole purpose of submitting information in relation to his/her own assessment. The applicant undertakes not to pass these details to any other individual or legal entity.

Privacy Policy:
In order for us to undertake our work it will be necessary for use to store personal information about you and/or your Company.
If you use our website as a Letting Agent (having registered) a Landlord (having registered) or a prospective tenant or Guarantor then we will treat all information supplied to us in accordance with the following policy:
Landlord Assist may pass your personal information to other organisations for the purposes of tenant referencing. If you visit our site, having been introduced to the site by a third party site then information supplied by you may be passed onto the relevant third party.
Our privacy policy does not extend to any third party sites that you may visit via our website or those which direct you to our site from another.
All necessary information supplied to us will be processed and stored on a secure server and may be used during subsequent visits to facilitate easy repeated use. The transaction process will use data encrypted using a secure socket layer session encrypted to the highest level available to your browser.
All storage, use and transmission of personal information relating to an individual or a company is subject to 1998 Data Protection Act. You can obtain a copy of all the details held by applying in writing, enclosing an administration fee of £10 plus VAT at prevailing rate made payable to LANDLORD ASSIST LIMITED at 141 Canterbury Road, Westbrook, Kent CT9 5BD.
Charges:
The Client will be charged in relation to our tenant referencing according to the prevailing charges. These charges may be amended from time to time however we shall provide notice of any changes in charges.
The Client accepts full responsibility for all charges arising from use of the account whether or not the charges arise from the activity undertaken or authorised by the Client.
The Client will make payment within 14 days of receipt of a correct Landlord Assist invoice. In the case of Clients who are individual landlords, Landlord Assist will require prepayment.
Use of Service:
Clients and Applicants must not restrict any other Client or Applicant from using our services. Nor should any Client or Applicant upload, post, publish, transmit, reproduce or distribute information or other material regarding Landlord Assist without our express consent.
Clients and Applicants confirm that they will not release any information gained from our site or our referencing service to any third party other than those with a legitimate interest in the outcome of the tenant assessment.
All Clients will ensure that the tenant referencing services provided to them or their company are used for the sole purpose of assessing tenant and/or Guarantor suitability and for no other purpose.

Accuracy:
:All reasonable endeavours have been taken to ensure that the information provided is accurate and current. Notwithstanding, Landlord Assist does not warrant that the information is accurate or complete. All Clients and Applicants accept that some information contained within our website is provided by third parties and we certainly do not have control over the accuracy or completeness of any third party data.
Service Availability:
Tenant Referencing is generally available 24 hours a day and progress on referencing can be tracked online 24 hours each day. We are available by telephone Monday to Friday 8am to 8pm on 08707 662288.
Limitation of Liability:
Access to our services may be prevented by factors outside of the control of Landlord Assist such as hardware of software malfunction. We shall not accept any liability for any loss which may result as a result of such events.
Force Majeure:
Landlord Assist shall not be liable to the Client nor Applicant for any breach of these conditions or any failure to provide or any delay in providing our services which are as a result of circumstances beyond our control. Including but not exclusively fire, strike, industrial dispute, breakdown of network system, explosion, accident and war.
Complaints:
Landlord Assist make considerable efforts to ensure that we meet the expectation of all Clients and Applicants however should you feel that we have failed to do so then please write, in the first instance, to Landlord Assist Tenant Referencing, 141 Canterbury Road, Westbrook, Kent CT9 5BD.
The data processed by Landlord Assist concerning your proposed tenants and Guarantors is of a sensitive and personal nature. You must ensure that all individuals who are referenced by Landlord Assist on your behalf give their consent. By agreeing to our terms and conditions you are confirming that you have the express consent of the tenant and where applicable Guarantor that we can undertake credit and other searches. Failure to gain this authorisation is a breach of the UK Data Protection Act. Our service is on the understanding that the requesting user has obtained the applicants authorisation to make enquiries and consult, among others, a credit reference agency.
